10% OF MLNG TRAIN 9 STAKE SOLD - SARAWAK STATE’S EQUITY IN MLNG IS STATE’S PRIVILAGE AS NOT ANYBODY CAN PARTICIPATE IN THE PROJECT – TOK NAN LAST DUN WINDING-UP SPEECH.

As of today Sarawakians are still very much in the dark as to the progress and status of the negotiation of devolution of power announced  during the DUN winding speech.

Tok Nan’s winding speech on the 30th Novermber, 2016, amongst other thing touched on the following.

DEVOLUTION OF POWER

As early as the 16th of March 2014, two weeks after To Nan was appointed as Sarawak Chief Minister, he had emphasised that Sarawak's relationship with the Federal Government must be constitutionally correct.

When  asked by the reporter from the Star, on what is Sarawak’s position with regard to Sarawak’s relationship with Kuala Lumpur and Tok Nan said that it must be constitutionally correct.

By that he meant,  in order to achieve it, the Sarawak Government at the State Legislative Assembly sitting on the 8th December 2015 had sought and was given a mandate for the State Government to safeguard the constitutional rights and protection of the State in the interest of all Sarawakians.

The mandate given covered the aspirations of the people of Sarawak from the days before the formation of Malaysia as stipulated in the Cobbold Commission Report, Inter- Governmental Committee Report and Malaysia Agreement and Malaysia Act.

Pursuant to this, the Government through its officials has actively and carefully planned a structured course of action toward achieving the following objectives.

Recently, Sarawak state Government sent its minister, officers and representative to get a closer look at the authentic documents related an agreement that lead to the formation of Malaysia.

The course of action involves three phases namely;

(a) Administrative empowerment;
(b) Encroachment of State's rights; and
(c) Oil and Gas Royalty.

On 21st January 2016, Tok Nan had announced 13 provisions of administrative empowerment to be delegated to the State Government which were agreed upon during my meeting with the Right Honourable Prime Minister.

The 13 provisions of administrative empowerment drawn by him were as follows:-

(a)            Sarawak Legal Officers are to be authorised by the Public Prosecutor under the Criminal Procedure Code to conduct prosecution for offences under the State Ordinances from the stage a person is charged in the lower court until the appeal stage. According to the Constitution, only the Federal Attorney General had the power to prosecute under any law. So he must delegate this power to State Officers. So we have now the power to prosecute under State Ordinances by our own officers.


In light of the recent Devolution of Power exercise agreed between the Federal and State Governments, several officers of the State Attorney-General's Chambers have on 1st March 2016 been appointed as Deputy Public Prosecutors.

Since then a total of sixteen (16) forest cases have been approved for prosecution. Ten (10) cases have been duly charged in Court with four (4) cases have been successfully prosecuted and the remaining six (6) cases are pending for trial. Another six (6) cases are pending for charges to be filed in Court.

Following the successful prosecutions, a total amount of RM77,719.60 in compensation was ordered by the Court to be paid to the State Government. This amount is over and above the fine imposed by the Court.

(b)    It is agreed for the Delegation of Power to the State officers to represent the Public Service Commission and the Education Service Commission in the appointment of officers to the Federal Civil Service, including teaching and medical services. This is another delegation of power by the Federal authorities to the State authorities;

(c)    Posts in Sarawak Immigration Department will be increased to improve the enforcement functions in the State with an increase of 100 new posts, with full deployment by the end of next month. As of today, out of 100 new posts, 99 posts have been filled. That means we do not have to appeal to the Federal authority every time we need a new post. We can do it on our own.

(d)    The ratio of Sarawak-born teachers serving in Sarawak will be increased to 90% of the total number of teachers in Sarawak by 2018. To ensure that this target is achieved, temporary teachers from the open market will be considered from time to time and obtain their Diploma in Education while teaching. As of today, out of the total number of 42,235 teachers in Sarawak, 37,921 of them are Sarawak-born teachers which is about 89.8% of the total number of teachers in Sarawak;

(e)    Traffic warden power for Sarawak Local Authorities will be given to the Miri City Council, apart from Kuching North City Hall and Kuching South City Council;

(f)     The Sarawak State Government will be consulted before an application for a Deep Sea Fishing Permit is forwarded to the Deep Sea Permit Evaluation Committee for consideration. The Ministry of Agriculture and Rural Economy is the representative of the State Government in the Deep Sea Permit Evaluation Committee;

(g)    The Sarawak State Government will be consulted in the drafting of Federal legislation which has bearing or impact to the Sarawak State Government, where provided by law. In this respect, the State Government was consulted for example amongst others with regard to the Integrated Water Resources Management Bill and Amendment to the Gas Supply Act 2016;

(h)    The planning of Federal development projects in Sarawak will be based on the priorities and strategic thrusts of the State Five-Year Development Plan. Implementation of the projects will be referred by the Federal Ministries to the State Government such as in determining the location of schools, hospitals and other development projects. This initiative is now being implemented;

(i)     The Higher Education Ministry will take necessary measures to increase the number of student enrolment from amongst Sarawakians with medical degree programmes in public universities. In this respect, of late I have learned that the Federal Higher Education Ministry following the steps taken for Sarawak will eventually recognise the United Examination Certificate on two conditions, the teaching of Bahasa Malaysia at SPM level and History Malaysia instead of History of some other country within the curriculum. So, this matter will be considered but we in Sarawak are the first to recognise UEC. So we hope that the Federal Government will also follow suit. Sarawakian will be given a greater opportunity to enter foundation studies programmes in UNIMAS. In this respect, UNIMAS has been empowered to manage the intake of medical students to allocate the quota of 80% for Sarawak born students;

(j)     It is agreed that relevant areas that can be delegated will be identified for delegation of power of the Director General under Section 49 of the Environmental Quality Act 1974 to the State officers or departments. Both the State and Federal Governments have agreed on the matters to be delegated and are now in an advanced stage of such empowerment;

(k)    Development of housing projects in Sarawak is to be implemented through a Joint Committee Meeting to ensure that State agencies are fully involved in the planning, implementation and monitoring aspects of these projects in Sarawak;

(l)     It is agreed that the development of sports in Sarawak is jointly managed with the State Government. The Federal Youth and Sports Ministry is also in the process of enhancing the Sports Development Act, 1997 which is expected to be completed by the end of the year. Certain aspect of the Sport Development Act, 1997 is under review by the parties to look into the possibilities of enhancing the involvement of the State Government including the organisation of international/national sporting events; and

(m)   It is agreed that the Sarawak Government will carry out all functions under the Social Welfare Department. All posts will be transferred to State Civil Service. The Federal Government will contribute 50% of the total costs incurred as decided by the National Finance Council. In this regard, the State Cabinet will be deliberating and making a decision on the terms and conditions of these initiatives in the coming months. These 13 provisions of administrative empowerment are progressively fulfilled by the Federal Government and we will continue to seek more empowerment to the State which can bring better benefits including areas related to tourism and education. The second phase involves the priorities subject matter relating to:-

(a) Finance

                (i) Financial Review under Article 112D of the Federal Constitution;
(ii) Import Duty and Excise Duty on Petroleum Products; and
(iii) Federal Financial Obligation for Expenditure in Concurrent List.

(b) Oil Exploration, Mining and Gas
(i) Minerals, Oil and Oilfields; and
(ii) Distribution of Gas.

(c)    Land and Revenue from Land Stamp Duties Chargeable on Instruments Prescribed by the Land Code for Transfer, Charge and Sublease ought to be returned to Sarawak. These issues are at an advanced stage of negotiation by the State and Federal officers in the Technical Committee set up to look into these priorities issues. Negotiations are on-going with the relevant parties. As the negotiations have yet to be finalised, the details of this meetings cannot be made public as yet. However, I wish to inform this august House that the next meeting of the Technical Committee will be held tomorrow, 1st December 2016. Matters not in the priority list will be dealt with after the issues in the priority list have been dealt with.


Tok Nan’s winding speech also include the much debated and speculated issues amongst Sarawakian and Sabahan, - “UPDATE ON THE OIL ROYALTY NEGOTIATION”

He  told the August House that the oil market has shown signs that are heading towards a more balance situation, despite continuing volatility and challenges. The World Bank’s Commodity Markets Outlook, October 2016 projected crude oil prices are to average at USD43 per barrel in 2016, a decline of 15% from the previous year (2015), and average at USD55 per barrel in 2017.

However, the forecast assumes OPEC will succeed in limiting global production, and that U.S. production will flatten out next year.

Despite the uncertainty in the oil market, the States’ negotiation on the request for the increase of oil royalty from 5% to 20% with the Federal Government and PETRONAS will continue.

Sadly, today, 242 days (2/3 of a year)  after Tok Nan’s last winding speech in the Sarawak DUN,  no conclusion has been reached on the rate of Petroleum Royalty that Sarawak State will get from Petronas is announced.

The DUN was also told that some progress in five key areas of negotiation with PETRONAS has been made namely,

(a) Natural Gas Supply for both Power and Non-Power Sectors;

(b) Equity and Royalty;

(c) Contracts and Business Opportunities;

(d) Corporate Social Responsibility; and

(e) Human Resource, Education and Technical Trainings.

On the natural gas supply, Tok Nan also announced that PETRONAS has signed five  agreements to support the development of power and petrochemical industry in the State, namely,

(a) Principle Agreement with the Government of Sarawak on the Supply of 450 million standard cubic feet per day of natural gas for the power and non-power sectors in the State of Sarawak on 3rd April 2016;

(b) Gas Sales Agreement with Sarawak Energy Berhad to supply 100 million standard cubic feet per day of natural gas for Tanjung Kidurong Power Plant on 3rd April 2016;

(c) Memorandum of Understanding with the Government of Sarawak to conduct a Joint Study for Sarawak Petrochemical Master Plan on 3rdApril 2016;

(d) Heads of Agreement with HUCHEMS for the supply of 58 million standard cubic feet per day of natural gas to HUCHEMS' petrochemical complex on 11th November 2016; and

(e) Memorandum of Understanding with Yayasan Hartanah Bumiputera Sarawak to jointly conduct a Pre-Feasibility Study for a Proposed Methanol Plant Project in Bintulu on 11th November 2016.

Through these agreements, PETRONAS has committed to supply 450 million standard cubic feet per day of natural gas to Sarawak for the power and non-power sectors development in the State.

According to him, Sarawak State will continue to negotiate for the supply of more natural gas from PETRONAS for our downstream activities.

The availability of natural gas in Sarawak will attract more petrochemical industries to invest especially in Bintulu that will support states’ industrialisation strategy to transform Bintulu to be the leading petrochemical hub in Malaysia and believe that the Sarawak Petrochemical Master Plan will also help the strate to develop its petrochemical industries in a strategic manner.

In his DUN winding speech Tok Nan also inform the members of the House that the number of Sarawak licensed of registered companies with PETRONAS have increased from 314 to 396 in 2016 and will continue to negotiate with PETRONAS to enhance the participation of Sarawak companies in oil and gas industry and pursuing to have more contracts to be given to our Sarawak companies.

In the same speech, Tok Nan said PETRONAS has committed a baseline value of RM2.1 billion worth of contracts annually to be awarded to Sarawak companies. Since 2013, PETRONAS has already spent RM14.8 billion worth of contracts for Sarawak companies.




He also told the August House that the State Government is also in active discussion with PETRONAS on the details of Shareholders Agreements on the 10% equity in the MLNG Plant Train 9.

Despite being in active discussion mode assurance on the details of Shareholders Agreements on the 10% equity in the MLNG Plant Train 9,  today no conclusive agreement had been reached but surprisingly PETRONAS on Wednesday 26 July, 2017 had reached an agreement to dispose of 10% of its shares and interest in the Bintulu MLNG Plant Train 9  for RM2.14 Billion to PTT (Thailand) on the same week it sends the first LNG delivery to the same Company which it believes was made to boost LNG market in Thailand. 

Today, if the deal is to proceed,  the share equity of the Bintulu MLNG Plant Train 9 would be :


PETRONAS         - 80%, 
JX Nippon           - 10% and 
PTT
Thailand     - 10%.

There is no official announcement been made by the
Sarawak State Government on the disposal of 10% equity in the Bintulu MLNG Train 9 Plant by Petronas.

I am of the opinion that the sale of  the above 10% equity in the Bintulu MLNG Train 9 Plant is not independent of the supply of LNG from the Gas field located off the coast of Bintulu, the ownership of which is the State Government of Sarawak. In such a circumstance PETRONAS should have consulted the Sarawak State Government before disposing its state to a foreign entity.

Without consultation by PETRONAS, Sarawak is merely a by stander, while equity changed hand to foreign entity that involved the States’ Bintulu LNG Assets.

By letting such action to proceed without any consultation with the State Government,  it can be construed that Sarawak Government is deemed to agree to the notion that the states’ LNG Asset that supplied the MLNG Train 9 Plant with the LNG does not belong to the Sarawak State government.

Sarawak State Government just cannot let this suspicious act to happen if it wants the state to have better involvement and economic return from its LNG Assets. What just had happened  is a regression of what Tok Nan had precisely emphasized during his last DUN winding up speech in December, 2016.

Tok Nan also said that the state is also working with PETRONAS for more equity in MLNG 2 Plant. Before the state would get any thing right, PETRONAS has just ceased the first opportunity from the state and Sarawakians at large.

He also said that the “State’s equity in MLNG projects is the state’s privilege as not anybody can participate in the projects”. This statement qualifies that no shares or involvement of other party can be tolerated as it is the state’s privilege.

The state government is not doing enough to protect the state’s right, particularly those that had been passed during the last DUN meeting. The current administration under YAB KM  Datuk Abang Johari has repeatedly on may occasions, making assurance that  he will carry on with  what Tok Nan has put in the pipeline, particularly those that involve state’s oil and gas, but what had happened during the past 242 days seems to go not in accordance to it.     

For Corporate Social Responsibility, PETRONAS is committed to spend RM50 million over 5 years from 2015 until 2019 for 10 projects.

Currently eight (8) projects have started and are ongoing namely the Development of

Community Centre,
Sarawak Regatta,
Contribution to NGOs, Mobile CSR,
Penan Pre-School,
Emergency Aids and PETRONAS Marine Conservation.

Another two (2) projects will start soon namely

PETROSAINS,
Play smart and Rest and Recreation Areas.

In the area of human resource, education and technical trainings, PETRONAS will continue to intensify education and human capital development efforts in Sarawak. PETRONAS is expected to spend RM465 million, exceeding the budget of RM420 meant for 5 years from 2015 until 2019 on:

(a) Capital expenditure for the construction of new MRSM Bintulu;
(b) Implementation of Asrama Desa projects; and
(c) Educational sponsors and building capacity for students.

The following are PETRONAS contribution in education and human capital development:

(a) 680 students sponsored under PETRONAS Education Sponsorship Program to pursue tertiary education in 2003;

(b) 1,054 students sponsored under Program Sentuhan Ilmu PETRONAS to drive academic excellence;

(c) 1,008 trainees given the technical skill training support under PETRONAS VISTA;

(d) 47 students participated in Graduate Employment;

(e) 687 students graduated from University Teknologi;

(f) 1,945 trainees sponsored at Institut Teknologi Petroleum; and
(g) 95 students sponsored at Akademi Laut Malaysia.

Currently there are 3,880 Sarawakians or 75% of the total workforce being employed by PETRONAS for its Sarawak operation covering both upstream and downstream including senior positions.

However, after our negotiation with PETRONAS to increase the number of Sarawakians working with PETRONAS, they have charted a Roadmap to recruit and develop more Sarawakians to achieve the targeted job level of 85% for Sarawakians by 2020.

The Localisation Plan was developed to increase the numbers of qualified Sarawakians in PETRONAS through Structured Succession Planning and New Recruitment through advertisement.

The Structured Succession Planning of Sarawakians filling up positions on Non-Sarawakians is on-going since September 2016. For the new recruitment, 192 vacancies (meant for Sarawakians) were advertised in the local papers

Utusan Borneo, Borneo Post and New Sarawak Tribune etc

As of 8th November, PETRONAS has received 10,000 applications (including non-Sarawakians) and shortlisting is in process.

Efforts are also in place to further up skill and create future qualified Sarawakians leaders.

Placement of Sarawakians at Universiti Teknologi PETRONAS and Institut Teknologi Program PETRONAS will continue to be done based on merit.

PETRONAS will continue to expand outreach programme to encourage more Sarawakian students to enrol in the University.

PETRONAS will also continue to support technical training programmes in Sarawak via PETRONAS Vocational Institution Sponsorship and Training Assistance Programme which include the funding of technical programmes, consumable and Training of Trainers as well as sponsorship of trainees.”

The current state administration MUST make official public statement and or announcement as to what extent the state government and the Federal government and PETRONAS has delivered, achieved eversince Tok Nan’s  last announced in the September 30th  2016 DUN sitting.

DISEBALIK KEJAHILAN PERKARA PENTADBIRAN NEGERI

Terus tetrang,  tidak dapat dinafikan memang terdapat dari kalangan pemimpin-pemimpin Sarawak yang jahil MA63 atau lebih tepatnya bersikap mendiam dan berdiam diri apabila terdapat atau muncul perkara yang biasanya akan dilabelkan sebagai "sensitif" berhubung hak-hak negeri Sarawak disentuh. 

Contohnya (sebahagian)

(1) Essential Order No 7 & 10 semasa pengistihaan darurat. 

(2) Pindaan kepada Territorial Sea Act

(3) Pindaan Perlembagaan 1976 - menurun status Sabah Sarawak sebagai Rakan Kongsi ke status sama dengan negeri dalam kesatuan Malaya.

(4) Perkara berhubung layanan senget sebelah Petronas terhadap penyertaan pengisian jawatan dan peluang perniagaan anak-anak tempatan sejak 1974.

(5) Undang-undang cukai pelancungan.




Rata-rata pemimpin Sabah Sarawak sama ada dari kalangan ahli-ahli DUN, menteri-menteri, termasuklah ahli-ahli parlimen dan menteri di peringkat persekutuan mengambil sikap mudah dengan mendiamkan diri, malah dianjurkan agar ahli-ahli DUN, ahli-ahli parlimen dan menteri kerajaan Negeri dan persekutuan agar tidak buat bising. Kalau buat bising nascaya periuk nasi akan terbang.

Perkara menakut-nakut itu bukan saja berlaku diperingkat negeri malah juga dianjur diperingkat persekutuan.

Itulah sikap pemimpin-pemimpin negeri sejak 1963 lagi,  yang membuat rakyat menjadi serik dan bosan walaupun ianya melibatkan perkara fundamental dalam penubuhan negara Malaysia.

Pemimpin-pemimpin juga bersikap seolah-olah kuasa DUN itu kuasa atau milik eksekutif, dimana ianaya layak diberi atau serah kepada kerajaan pusat dengan sewenang-wenangnya, hanya dengan berunding, tanpa ianya di bawa ke mesyuarat kerajaan negeri.

Manakala pemimpin pusat bersikap mengambil jalan mudah tanpa merujuk dan memohon persetujuan kerajaan negeri berhubung perkara-perkara yang terang-terang menyentuh hak-hak negeri sebagai rakan kongsi seperti yang termaktub dalam MA63 dan Perlembagaan Persekutuan.

Setelah sudah sekian lama bersama-sama membentuk Malaysia perkara berhubung kuasa-kuasa negeri dan persekutuan tidak lagi menjadi masaalah pokok tau menjadi bahan politik dan ianyan harus diselesai diperingkat teknikal oleh Setiausaha Negara dan Negeri bersama-sama AG-AG masing-masing nya.

Jika badan-badan ini gagal berfungi atau gagal berfungsi dengan bebas maka Sabah, Sarawak dan Malaya harus bentuk satu badan yang bebas pengaruh pokitik agar kerja teknikal berkaitan kuasa-kuasa negeri dan persekutuan itu dapat di lakukan tanpa ada percangahan. 

Mengambil jalan mudah mengguna  'pintu belakang' tanpa merujuk samada apa yang dipinda dalam perlembagaan persekutuan itu bertentangan dengan MA63 atau dan Perlembagaan persekutuan.

Delima ini berterusan sehinggalah sampai ke zaman internet dan sosial media dimana luahan rakyat yang kritikal dengan cara pentadbiran negeri dan Negara dilakukan mulai kedengaran di media sosial. 

Malah mereka(pengkritik) tidak bebas dari mendapat kecaman pemimpin dan rakyat yang mengampu mereka.

Media arus perdana tempatan juga bersikap mengelak untuk memuatkan suara-suara yang mengkritik pentadbiran kerajaan negeri dan memuatkan pandangan pemimpin-peminpin negeri dan menolak pendapat dari kalangan orang awam yang menegur kepimpinan-pemimpin mereka.

Malah media arus perdana tempatan juga di pantau rapi agar pendapat yang tidak selari dengan kepimpinan negeri tidak disiar. Akhbar yang engkar akan di tarik permit untuk bersiar dan perkara seperti ini pernah berlaku di Sarawak.

Rakyat awam menjadi muak.

Nah, hari ini dengan adanya media sosial, pendapat yang bernas dari orang awam tidak dapat di tutup lagi. Malah pendapat yang bernas atau perkara yang 'bernar tetap benar' itu tidak dapat lagi di tutup atau dihindar lagi dari pengetahuan umum.

Pendapat yang bernas yang mengandungi kebenaran itu diterima oleh orang ramai dan sedikit-demi sedikit di ambil perhatian oleh kerajaan.

Inilah apa sebenarnya yang telah berlaku sejak hampir 55 yang lalu, disebalik kejahilan keatas perkara berhubung MA63 dan ia juga termasuk perkara lain berkaitan pentadbiran kerajaan di Sarawak.

APAKAH KEDUDUKAN YANG DIAMBIL OLEH KERAJAAN NEGERI SARAWAK DALAM PERUNDINGAN BERHUBUNG HAK MINYAK SARAWAK?

APAKAH KEDUDUKAN YANG DIAMBIL OLEH KERAJAAN NEGERI SARAWAK DALAM PERUNDINGAN BERHUBUNG HAK MINYAK SARAWAK?

Belum ada pengumuman dibuat di DUN negeri Sarawak atau pun kepada rakyat Sarawak berkenaan status atau KEDUDUKAN kerajaan Sarawak berhubung pemilikan kawasan-kawasan minyak dan gas di perairannya.

Mengikut  Tuan Zainnal Ajamain dalam beberapa siri video beliau, kedudukan Sarawak dan Sabah berhubung pemilikan kawasan minyak diperairan Sabah dan Sarawak,  secara automatiknya sudah menjadi milik kerajaan Negeri Sabah dan Sarawak.

Keadaan tersebut berlaku apabila DS Najib, Perdana Menteri Malaysia mengistiharkan undang-undang Darurat yg di istiharkan pada 15/5/1969 dibatalkan di Parlimen pada 23/11/2011.

Dengan pengistihiraan pembatalan tersebut maka undang-undang yang di buat  semasa darurat itu pun turut terbatal, (6 bulan dari tarikh pengistihiraan itu dibuat oleh DS Najib di Parlimen pada 23/11/2011 iaitu 24/5/2012)

Dengan pembatalan itu maka undang yang menghadkan perairan Sabah dan Sarawak kepada 3 nm pun turut terbatal. Maka sempadan perairan Sabah dan Sarawak kembali kepada sempadan asalnya iaitu seperti yang diistihar melalui  Order in Council 1954 yang dibuat oleh Ratu Elezabeth England.

Ada beberapa keadaan boleh terjadi, samada

(1) Sarawak mengambil kedudukan sebagai pemilik kawasan minyak

 ATAU

(2) Kerajaan Persekutuan sebagai pemilik (seperti keadaan sebelum 24/5/2012 ( Tarikh berkuatkuasanya undang-undang Darurat 15/3/69 dibatalkan)

ATAU

(3) Kerajaan Negeri Sarawak sebagai pemilik kawasan minyak tetapi menyerahkan (vesting) kawasan minyak itu kepada Petronas.

ATAU apa-apa keputusan lain yang dibuat oleh kerajaan Negeri Sarawak selain kedudukan (1), (2) dan (3) diatas.

Mana satu diantara KEDUDUKAN diatas kah yang diambil oleh kerajaan Negeri Sarawak dalam perbincangannya dengan Kerajaan persekutuan?

Persoalan ini belum lagi diumum di DUN Negeri Sarawak atau kepada rakyat Sarawak setakat ini, walaubagaimana pun wakil Kerajaan Negeri dalam beberapa liputan akhbar ada menyatakan, bahawa ianya masih dalam proses perundingan.


PEMBENTUKAN  SYARIKAT MINYAK SARAWAK

Kerajaan Sarawak boleh membentuk syarikat minyaknya sendiri -

(1) Dengan mengwujudkan satu badan atau syarikat milik penuh kerajaan negeri yang bertindak sebagai KUSTODIAN kepada kawasan minyak milik kerajaan Negeri Sarawak (sekira Sarawak ambil KEDUDUKAN SEBAGAI PEMILIK KAWASAN MINYAKNYA)

ATAU

(2) Sebagai sebuah syarikat yang bertindak sebagai kontraktor atau sebagai salah satu pihak dalam sesebuah Production Sharing Contract jika Kerajaan Persekutuan masih mengekal kedudukan dan bertindak sebagai pemilik kawasan minyak yang terdapat di perairan Sarawak. Dengan demikian masih mengekalkan PETRONAS dikedudukan sebelum ini, iaitu sebagai KUSTODIAN kepada Kerajaan Persekutuan.

ATAU

(3) Dimana Kerajaan Sarawak berkedudukan sebagai pemilik kawasan minyak tetapi menyerahkan (vesting) milikannya itu kepada Petronas dan syarikat minyak sarawak  akan bertindak sebagai kontraktor atau sebagai salah satu daripada pihak dalam sesebuah Production Sharing Contract bersama-sama denan Petronas dalam memajukan sesebuah kawasan minyak dsn gas dikawasan Sarawak


Dalam mana-mana KEDUDUKAN diatas,  syarikat minyak boleh dibentuk dengan cara -:

1) Syarikat Minyak Sarawak  diperbadankan dibawah Enakmen DUN Negeri Sarawak, ( seperti sesco, stidc, sedc dsb)

2) Diperbadan dibawah Enakmen DUN Negeri Sarawak untuk menubuh syarikat dibawah Akta Syarikat 2016 (seperti Petronas yang di tubuh dibawah Akta Parliament iaitu Akta  Petroleum 1976 dengan menubuh syarikat berhad dibawah Akta Syarikat, 1965)

3) Atau terus memperbadankan syarikat dibawah Akta Syarikat 2016 dengan konsitusi (Memorandum and Articles of Association) mengikut citra rasa dan kesesuaian Kerajaan Negeri Sarawak.


Apa jua kedudukan dan keputusan Kerajaan Negeri Sarawak ke atas kawasan minyak dan gas Sarawak tidak harus membelakangi DUN Sarawak.

Keputusan mestilah mendapat restu DUN Sarawak kerana ia melibatkan harta yang benilai berbilion yang hurus dibelanja secara berkhemah untuk nembangunkan Sarawak dan untuk masa depan generasi yang akan datang.



APA BAHAYANYA SEKIRANYA KERAJAAN SARAWAK TIDAK MENGAMBIL KEDUDUKAN SEBAGAI PEMILIK KAWASAN MINYAKNYA. - (MEMPERKAUI KESALAHAN SEBAGAI KEBENARAN)

(1) Kerajaan Sarawak sendiri turut serta dengan kerajaan persekutuan sama-sama tidak akur atau mengingkari dan melanggar kedudukan di mana Sarawak adalah pemilik kawasan minyak ( selepas pengistihiraan pembatalan undang-undang Darurat 15/5/1969, dibuat di Parlimen pada 23/11/2011 oleg)

(2) Kerajaan Sarawak boleh dianggap sebagai MENGIAKAN atau bersetuju bahawa kawasan minyak yang dimiliki nya itu di ambil milikannya oleh kerajaan persekutuan - mengikut tindaktanduk/perbuatan (act) Kerajaan Negeri Sarawak itu sendiri.

(3) Kedudukan yang salah yang diambil oleh Kerajaan Negeri Sarawak boleh digunakan oleh Kerajaan Persekutuan sebagai alasan untuk mempertahankan diri (defence) dalam sesuatu timbangtara atau perbicaraan sekira tercetus perselisihan faham.

(4) Tidak bertindak atau tidak berbuat sesuatu mengikut kebenaran kedudukan Sarawak sebagai pemilik kawasan minyak itu diambil sebagai suatu persetujuan keatas kedudukan pemilikan yang tidak benar.

STOP INFRINGING SABAH AND SARAWAK STATES' RIGHTS

The federal government of Malaysia should not introduce Laws that affect Sabah and Sarawak which is contradictory to the provision of the Malaysia Agreement 1963 and The Federal constitution.

Throughout the 53 year of Malaysia, the State Government of Sabah and Sarawak had not been properly notified or consulted by the Federal Government on policies that affect the two states that result in erosion of state powers as well as lob-sided policy implementation on regional basis.

This had been particularly due to ignorance of its own MPs who represented the two states on matters affecting the rights of the state Sabah and Sarawak.

As a result significant number of provision of the Malaysia Agreement 1963 and the Federal constitution had been infringed resulting in much discontentment amongst Sabahans and Sarawakians.

It had also resulted in significant stresses and lags in economic  progress in both states. The state of Sabah and Sarawak, although blessed with natural wealth remained as state of the most populous number poorest people with poor basic infrastructure as compared to most states in the Peninsula Malaysia.

Both the State and the federal government should form a body to assist the Attorney General of  the states of Sabah, Sarawak and the Federal Government, before policies or bill are to be tabled in the Dewan Rakyat so as to ensure that no provision of the Malaysian agreement and the Malaysian Constitution are repeatedly infringed upon.

The provision of the Malaysian Agreement and the Federal Constitution that had been repeatedly infringed and thus it must be rectified to the position it was suppose to be on the date Malaysian Agreement was adopted.

As to the introduction of Tourism Tax Laws that will take effect on the 1stday of July, 2017, the state Government of Sabah and Sarawak should be consulted to make sure that all the provision of the Act meet the requirement of the Malaysian Agreement 1963 and to sort out details as to how the proceed from the implementation of the laws shall be divided and spent.

The Oil & Gas rights of the State of Sabah and Sarawak had seen no clear, definite and significant changes in negotiation development although the right upon which the federal government held to the territorial water of Sabah and Sarawak had long been relinquished through and by the abrogation of The 1969 Emergency Law in Parliament on the May 23rd, 2011  by the Prime Minister.

42 years of Federal Oil and Gas policy had not significantly brought much favour to Sabah and Sarawak state. The policy instead had brought poverty to the people in the State of Sabah and Sarawak. The federal Government had failed miserably to implement a fair and sound policy to enable it to distribute the states' wealth back to the people of Sabah & Sarawak through fair participation in oil and gas business and employment.

Time waits for no one and while oil and gas resources from the states' territory flowed endlessly to the benefit of the lob-sided policy, the Sarawak State Government had not made any up-to-date official announcement as to the states' position and status relating to the negotiation with the Federal Government.

If the Federal Government amassed the states' oil and gas wealth without having to inform the Sabah and Sarawak in 1969, why is it so difficult for the Sarawak State Government to implement laws and by laws to regulate its own oil and gas wealth?

The Sarawak State Government should act fast and failure to do so would jeopardize the livelihood of Sarawakians who should have deserved the long overdue fair share and distribution of the states' wealth.


The provision of Malaysia Agreement and Malaysian Constitution that touched on Taxation.

No taxation imposed unless authorized by the law. Deemed to be that of Federal and states laws. 




The legislature of Borneo State may also make laws for imposing sales taxes and any sales taxes imposed by the state law in a Borneo State shall be deemed to be among the matters enumerated in the State List and NOT IN THE FEDERAL LIST but there shall not in the charging or administration of the State Sale Tax be any discrimination between  goods of the same description according to the place in which they originate and the charge for any Federal Sales Tax SHALL BE MET OUT OF SUMS COLLECTED FROM A PERSON LIABLE FOR THAT TAX before the charge for a State Tax.

The above provision clearly spelt out that the Federal Government must consult the State Government should it implement the Tourism Tax (which is a form of Sales Tax imposed and collected based on Sales of Tourism Products) in the State of Sabah and Sarawak.

CERITA KIT-KIT PEMBUAT VIRUS

Penulis virus senantiasa coba memudahkan pembikinan kod virus sebab *kebanyakan kod-kodnya ditulis dalam 'Assembly Language'  pada petingkat awal. Ianya agak sukar di capai pengunaannya oleh pengguna amatur.  maka lahirlah 'Virus Construction Kits' yang ada sekarang.

Ia mendorong penulis membangun applikasi pembuat virus atau 'generator' virus yg mudah digunakan oleh pengguna komputer biasa pada zaman 90an dimana hampir semua komputer ketika itu dimuat dengan MS Dos 6.xx, Win3.xx hinggalah Win9x ,yg terdapat fail .COM, .Sys .CofigSys, AutoExec.bat (batch file) yang biasanya menjadi sasaran penulis kod virus ketika itu.

Kits utk membuat virus juga semakin banyak dibangun atau direka utk platform/system baru yg berupaya jana lebih byk kod-kod yg lebih brutal seperti yg disebut diatas, termasuk juga fail dlm bentuk 'executable' (.exe), Ms Win executable, Batch & VBscript, Mirc Worms dsb.


Wujud lagi kit2 yg bukan saja boleh jana kod binary malah boleh buat source code yang boleh diguna oleh pengguna biasa atau amatur utk buat source code yg jauh lebih berupaya dari kit yg diguna utk membuat dirinya sendiri.

Yg buat applikasi pengesanan virus lagi berat adalah terdapat kits yg boleh guna encryption, anti debug, anti-emulation dan teknik blocking, mutasi dll nya.

Tahun 2000an berkesempatan mencoba kit 'Virus Construction set' yg sudah lama wujud (agaknya dlm awal 90an) yg boleh buat COM virus untuk kacau  fail .COM dlm sistem DOS yang mensasarkan AutoExec.bat file (saya sudah kongsikan command -command Dos ,  3-4 tahun yg lepas dlm grup ini), config.sys.

*Keupayan kit ini agak terbatas tapi boleh buka ruang creativity dari segi pendekatan utk capai objektifnya.* Kena duduk, mamah sehingga lunyai sehingga capai tahap gaban berbulan2 sehingga idea2 kecil mula muncul dan boleh buka suatu jln atau  pendekatan baru.

Kini terdapat ratusan kits2 yg user friendly dan boleh diguna oleh pengguna biasa termasuk kanak curious,  semuda 6 thn.

Tahun 90an kit GenVir dikeluarkan sebagai shareware sebelum kita dengar perkataan malware dan 'ware' yang lain sedangkan kita masih tidur lena dibuai kununnya kekayaan diperut bumi dan jauh sekali wujud makmal penuh (selain di universiti- agak kurang tarik minat pengiat).

Kit membuat Virus ini telah dikeluarkan di negara perancis (bukan dari pemikiran negara dunia ketiga pastinya) yang digunakan untuk menguji produk antiVirus yang ada kebolehan mengreplikasi (Trait yg mesti wujud dalam mereka virus).

Tidak banyak virus di reka menggunakan kit tersebut. Versi baru menyusul suaikan pengunaan nya untuk kepada naik taraf yg berlaku dgn sistem/versi Ms DOS ketika itu.

Dalam jangka masa yang sama kit VCL - Virus creation Lab di keluarkan pengiat NUKE code writer namum tidak diketahui berapa banyak rekaan telah dibuat hasil kit tersebut.

Walau bagaimana pun VCL miliki trait yang agak maju ketika itu dan nampak  medadului pereka kits virus lain dgn memudahkan kerja utk penulis2 kod virus.

Muncul pula DARK ANGEL yang membentuk kit mereka sendiri bersaing pembangun kit virus lain.

Walau agak sukar digunakan berbanding VCL kerana tidak mempunyai interface yang  'user friendly' dan pemacuanya berasaskan penulisan kod (script-driven)  tetapi ini sebnarnya telah membuat virus kits ini memikiki kemampuan lebih dari kits2 lain yg terdaoat ketika itu. Ia boleh diguna untuk meniru keuoayaan virus lain dan menokok tambah trait lain disamping keupayaan asasnya.

Sebagai xontoh, Virus Trojan horse, disamping kepupayaan asasnya,  penulis virus boleh klon dengan memuat arahan spesifik mengikut selera penulis kod.

Setelah mexuba bermain dengan virus2 untuk beberapa ketika dilihat agak sukar reka virus dalam ruang lingkup combinasi yang agak terhad namun, seperri kit-kit lain ia juga mampu buat kod "memory resident"  dan compile fail run-time yg dpt di eksekut (EXE file untuk di kompil ke kod binary yg di paham oleh mesin)

Mengikut penulis mahir yg saya ikuti kegiatannya, Kit ini memiliki kod generator yang mampu bertindak sebagai 'code morphing engine'. Kreativiti beliau beralih keluar kotak, mampu buat virus yg boleh menukar routin struktur dan enkripsi pada virus ciptaannya.  Satu evolusi kecil dgn beralih /shift pendekatan nya untuk berhadapan dengan targetnya.

Dark Angel kemudian membuat Kit generasi seterusnya yg menghalang pengguna melakukan kerja 'debug" ; dan emulasi, sekaligus kit tersebut dibekal dengan keupayaan decryption dan morphing yang lebih canggih dari pereka kits ketika itu.


Next Generation Virus Creation Kit

Ketika kita baru melangkah ke era pengunaan sistem windows 95 munxul pula NGVCK.

Virus Kits ini memiliki Assembly source-morphing engine yang boleh reka dan arah Function Random / 'random function ordering'.  Kits ini juga miliki keupayaan memasukkan 'Junk Code' dan 'method user defined encription'. Ia juga mampu serang sistem debuger dalam win95 dan teknik2  dan approach2 lain sesuai utk menghadap target.

Ianya juga memiliki keupayaan 'morphing' dan berkemampuan menutukar struktur dan rutin, maka apabila kita gunakan kit ini, Variant Virus 'baru'  akan tercipta secara automatiknya.

Lebih mudah buat source kod yg memiliki keupayaan morphing dari dari membuat 'morphing Engine' itu sendiri namun demikian teknik itu memudahkan pereka virus kemudiannya.

Terdapat juga generator copycat yg wujud yg boleh diguna untuk buat virus dikalangan pengiat yg kurang mahir, yg memikili kod mutasi yg boleh buat virus memiliki trait tersendiri termasuk kemampuan seperti yg dimiliki oleh virus 'Trojan' horse yg popular yang masih mengekalkan keupayaan serangan keatas fail EXE dan COM.

Kalau nak diceritakan semua kit2 membuat virus yg ada pada tahap tingkat bawah (low level) Assembly Language, yg mana telah  lalui evolusi sehingga ke tahap Oo (object oriented) yg makin mudah digunakan oleh pengguna 'biasa' termasuk tahap kanak-kanak yang punya daya ingin meneroka kebolehan virus yg mereka cipta.

Penulis kod virus semakin specifik dalam serangan mereka, sepeti macro virus yg boleh bertindak selagi source kod dapat di gunakan untuk melakuan arahan cara 'automatik' yg sudah pastinya terdapat dalam hampir setiap apllikasi seperti applikasi Office (Xls, Doc dan sebagainya).

Spy, Mal, Scare, *share,  dsb muncul dengan keupayaan dan target tersendiri.

Pokoknya virus mesti miliki sedikit sebanyak keupayaan mengjangkiti dan melakukan arahan seperti yang dikehendaki oleh tuannya/perekanya.

Untuk mempelajari virus amat payah pada awalnya terutama sebelum adanya internet. Bayangkan mode berjangkit hanyakah melalui applikasi yg di install dan melalui berkongsi disket dan pemindahan fail2 melalui laplink dan mungkin juga email (bagi yg sudah subscribe pada peringkat awaknya sekitar 1990.

Mempelajari Virus pada peringkat awal, dizaman sebelum ada internet ada senang dan ada payahnya.

Senangya - kerana Target Serangan tidak kompleks atau banyak. Contoh nya, berkisar dengan DOS, COm EXE yg terdapat pada sistem Microsoft tatkala sistem masih asas dan belum capai kompleksiti seperti yg ada dlm sistem selelas Win XP. Fail2 dalam Operating System dapat di setor dalam hard disk berkpaaiti 40MB - 500 MB sajaha (bukan GB).

Manakala kesusahannya pula adalah pada mendpt sumber rujukan dan bahan.  Rujukan tidak byk terdpt dlm internet kerana pengguna internet bermula dinegara ini sekitar 1992/3 melalui  JARING dan Kemudian TmNet1515 selain leaseline yg biasa diguna pelanggan korporat spti bank dsb.

Jujurnya, sumber utama mendpt kit2 adalah melalui kedai menjual perisian murah dlm disket dan CD. CD biasa memuatkan beratus utiliti dan kits2. Misalnya kits yg menyediakan compiler untuk bhs Assembly, termasuk bhs level tinggi Fortran,  C,C++, Borland C+, Pascal, Basic.

Virus Creation Kits mudah dan murah dibeli untuk tujuan mempelajari mana2 satu pilihan  idaman hati :)

Untuk kit2 reka virus, kenalah sediakan sistem berasingan yg  mengekalkal 'habitat asli' working computer yg sehat agar mengekal suasana 'natural habitat' atau target agar tidak asing untuk virus 'membiak' dan sekali gus membolehkan kita menyelidik upayanya dan kesan dari serangan virus-virus yang ada.

Besedialah dari bebagai bentuk serangan yg semestinya sudah dijangka. Dalam proses belajar itu sendiri kita akan berulang2 kali akan alami situasi yg tidak menetu / 'intermitent' akibat tindakan virus peliharaan itu sendiri dan suasana yg luar jangkaan boleh tercetus,  contohnya dgn keupayaan 'memori resident' yg terdapat pada virus dan  sebahagian lagi si peruntukan utk kerosakan / wujud dari intrigiti chip hardware yg lahir atas kesan atau bukan kesan virus peliharaan itu srndiri.

Bahasa Assembly itu adalah bahasa yg berhubung terus, dengan bahasa binari (1010, 1100 ) mesin melalui comand mnemonik/asas ( bahasa level /peringkat terbawah sekali ) dgn kod binari yg difahami hardware/mesin komputer. Bahasa Assembly ini terdpt /disediakan  Micosoft macro Assembler atau editor (MASM ver ???) x86 yg menguna syntax Dos samada 16bit atau 32bit manaksla ML64 utk source 64 bit .

Selain untuk reka virus, ASM di guna untuk reka kernal Sistem dan Driver untuk peripheral/aksesori/ komputer, malah kompiler itu sendiri pun ditulis dlm bahasa assembly, embeded device program & firmware,   debug, Reverse Engineering.

Disebabkan ianya bahasa asas, ianya ringan/cepat diproses kerana dasar 'one to one' dgn bhs mesin binari melalui arahan OP code dan Operand, Contoh arahan LD --> utk - 'Load', INC---> utk- 'Increment' ditertemah ke dlm bentuk binari dalam register prosessor  dan di terjemah ke Hexadecimal di loksi dlm chip memori.
Jika anda berminat sy pasti byk refernce yg boleh didapati dlm internet.

Pembininan virus kini sudah sampai tahap/level tinggi (jauh dari bhs mesin) dgn source code dan GUI yg user friendly membolehkan hampir semua pengguna yg fasih guna applikasi computer boleh reka virus melalui kit yg dimuat turun.

Virus, worms, berbagai jenis wares capitalize guna infrastruktur komunikasi wireless yg ada - network, sharing, email dsb. yg boleh diakses dari mana sahaja. Lebih membimbang encryption/decryption - akses dan blocking signal yg menjadi nyawa kpd sesuatu sistem.

WHERE IS RM3.2 BILLION? - OMISSION OF “PE2011” A TWO PART ANNUAL REPORT FOR SINGLE YEAR 2011 - IN PREVIOUS REPORT



OMISSION OF “PE2011” IN A TWO PART ANNUAL REPORT FOR SINGLE YEAR 2011, UNDER PREVIOUS BLOG REPORT



The first part of my blog has omitted the “PE2011” Annual Report which is one of a two part annual report, reporting in and for the same financial year 2011. 


In year 2011 Petronas has two(2) Annual Report, namely  “PE2011 Annual Report and 2011 Annual Report”


The contradicting figure of RM 18.4 Billion mentioned previously in my report arise due to such omission or exclusion.


Nevetheless, the inclusion of Annual Report PE2011 only reveal agreement up to Annual report 2014. In annual report 2015 the accumulated amount foregone resulting from the government’s fuel rationalization policy appeared to contradict by RM3.2 billion.  


2015 Annual report  reported that the accumulated revenue foregone up until end of 2015 was RM238.3 Billion  but the total annual revenue foregone for the same period appeared to be at RM241.50 Billion.  


The report appeared to show an understatement of RM3.2 Billion which bring us to the question of “a double folded” situation ;

(a)          The assumption that the accumulated revenue foregone of RM238.3 as reported in the 2015 annual report is correct and RM241.5 is false.
 
OR

(b)          the assumption that the total annual revenue foregone from 2009-2015 of RM241.5 is correct and RM238.3 is false.


Contradicting amount cannot be both correct or wrong at the same time without having it explained or reflected elsewhere in the report.


In situation (a) above, if the cumulative figure of RM238.3 billion is true then, the understatement would mean that RM3.2 billion could have been returned or reimbursed to Petronas?


Conversely,  if the total annual revenue foregone from 2008-2015 is RM241.4,  then a situation of an overstatement of RM3.2 billion happened and bring the report to a shortage of RM3.2 billion.


Anyway, Petronas or the minister incharge of Petronas is obliged to explain where the RM3.2 Billion had gone to?

 




WITH THE INCLUSION OF ANNUAL REPORTS PE2011 AND ANNUAL REPORT 2011 (TWO ANNUAL REPORT FOR SINGLE YEAR 2011)

The above figures are adopted from Petronas annual report for 2009-2015 which is made available as downloadable PDF file at its website.

The above table zooms in to the part called “Revenue foregone” and pages from which the figure is adopted is also noted in the above table.

The issue here is very simple and straight forward. Firstly it involved arithmetical accuracy. That is arithmetical discrepancy which need to be explained by Petronas because the amount involved a massive sum of RM 18.4 Billion, a sum which can easily complete the construction of one Pan Borneo Highway if it was to be built many years ago.


Let’s go slowly through the above table.

Row “B” is the yearly or annual amount of “Revenue Foregone” comprising those consumed by Tenaga Nasional Berhad(TNB), Independent Power Producer (IPP) and industrial and domestic user in Semanjung Malaysia.

In 2009, the total annual/yearly consumption by the above industry was RM 19.5 Billion and the accumulated value since May 1997 was RM97.5 Billion.

In 2010, the same body or industry (TNB,IPP& Insudtrial and Domestic) made an anuual consumption of RM18.9 Billion.

Now,  in the year 2010 the cumulative amount of “Income foregone” has increased from RM97.5 billion in  the year 2009 to RM116.4 billion in the year 2010. That is RM97.5 Billion (Year 2009 Cumulative figure) Plus RM18.9  equal to RM116.4 Billion. (“Total” column of Row B in the above table) At this stage the calculation correspond with Petronas’ Annual report as it appeared on page 17 of year 2010 Annual report.

Then, in the year 2011, the annual consumption of natural gas by the same above mentioned users was RM20.1 Billion. When the annual consumption of year 2011 is added to the cumulative figure brought forward from the year 2010, the total is RM136.5 Billion (“Total” column of Row B in the above table). The cumulative figure still correspond to that of  Petronas annual report figure as it appeared on page 37 of Petronas 2011 annual report.

In 2012, the annual consumption of natural gas of the same user was RM27.9 Billion and when this amount is added up to the cumulative figure brought forward from the previous year, ie 2011 of  RM136.5 Billion, the total is RM164.4 Billion BUT, the Petronas Annual report   on page 39 put it as as RM 182.8 billion.

Is this simply an arithmetical error ?  The difference of RM 164.4 and RM182.8 is RM18.4 Billion, and this amount is a huge sum of money that can be put into good use to complete the construction of Pan Borneo Highway if it were to be built many years ago.

Petronas must come with a satisfactory explanation as to where the missing RM18.4 Billion had gone or at least  explain where the corresponding entry or transaction appeared or dealt with elsewhere in its financial statement.

What the missing RM18.4 Billion simply means is that Petronas says that the accumulated value of  natural gas provided for free to the above mention users was RM182.8 Billion when in actual fact the calculation on the same, based on the same report showed that it was only RM164.4 Billion.

What it simply means is that Petronas has declared under oath that it has given up its stock of natural gas (as subsidies) to TNB and IPP valued at  RM182.8 Billion when in actual fact the calculation shows that it had given up only RM164.4 Billion. 

The question here is that where have the RM18.4 Billion worth of natural gas gone missing based on the amount it reported in its Annual report of 2012?

The inconsistencies in the Petronas annual report just don’t end in 2012. In the following year Petronas Annual report showed that it had foregone another RM24.9 Billion worth of natural gas to the same above mention users.  Petronas annual report of 2013 still maintain and brought forward the inconsistency or the missing amount of RM18.4 Billion from 2012 into its 2013  and 2014 annual report.  (refer  page 43 & 49 of Petronas Annual report 2013 & 2014 respectively)

Amazingly in 2015  Annual report (refer to page 63 of Petronas Annual report ),  an arithmetical disagreement  once again can be found that involved a reduction to the cumulative amount provided for to the users but the report for 2015 still show or maintain an over-statement to the accumulated amount provided for to the same users.

Petronas should come with a straight answer to explain to the public as to where the missing RM18.4 Billion had gone to as captured in its 2012 annual report and the same was brought forward to 2013 and 2014. 

In the 2015 report (Page 63 of Petronas Annual Report), the amount of RM18.4 Billion that was found missing had been reduced by RM3.2 Billion to RM15.2 Billion. 

Where in Petronas report or financial report has the same inconsistencies been reflected.?

Without satisfactory explanation, member of the public is obliged to lodge a report to the relevant authority as to the missing amount that appeared all throughout the 2009 to 2015 annual report.
